These Terms of Service (hereinafter referred to as the “Terms”) set forth the conditions for using the monthly subscription-based video streaming service (hereinafter referred to as the “Service”) provided by Mixed Jiu Jitsu (hereinafter referred to as the “Site”).
Article 1 (Scope of Application)
These Terms apply to all users of the Service.
Article 2 (Eligibility)
The Service is available only to individuals who are 18 years of age or older.
Use by minors is strictly prohibited.
Article 3 (Service Description)
The Service provides video content on a monthly subscription basis.
Article 4 (Payment)
Payments are processed through MemberPress and Stripe.
The subscription fee is automatically renewed. Unless the user cancels, charges will be billed automatically on a monthly basis.
Article 5 (Refund Policy)
As a general rule, no refunds will be provided.
However, refunds may be considered on a case-by-case basis if deemed appropriate by the Site due to technical issues or other valid reasons.
Article 6 (Prohibited Activities)
Users are prohibited from engaging in the following activities:
- Downloading videos
- Taking screenshots
- Recording content
- Unauthorized reproduction or redistribution
- Uploading content to social media or video platforms
- Sharing account information with third parties
- Unauthorized access to servers
- Any other activities deemed inappropriate by the Site
Article 7 (Account Suspension and Termination)
If a user violates these Terms, the Site may suspend or terminate the user’s account without prior notice.
In such cases, no refunds will be issued.
Article 8 (Intellectual Property Rights)
All copyrights and related rights to the content provided in the Service belong to the Site or to the rightful owners.
Article 9 (Damages and Penalties)
In the event of unauthorized reproduction or other violations of these Terms, the Site may claim the following from the user:
(1) Actual damages
(2) Attorney’s fees
(3) A penalty of JPY 1,000,000 per violation
The penalty set forth in the preceding paragraph does not preclude claims for additional damages.
Article 10 (Disclaimer)
The Site shall not be liable for service interruptions due to communication failures or system issues, unless caused by gross negligence.
The Site shall not be involved in disputes between users.
Article 11 (Data Retention)
User data after account termination will be retained for a reasonable period in accordance with the specifications of the systems used.
Article 12 (Governing Law and Jurisdiction)
These Terms shall be governed by the laws of Japan.
Any disputes arising in connection with the Service shall be subject to the exclusive jurisdiction of the Fukui District Court as the court of first instance.
Article 13 (Price Revision)
The Site may revise the subscription fee upon prior notice to users in the event of exchange rate fluctuations, changes in economic conditions, or other circumstances deemed necessary for service operation.
Continued use of the Service after such revision shall constitute acceptance of the revised pricing.
Article 14 (Amendments to the Terms)
The Site reserves the right to amend these Terms at any time without prior notice.
The revised Terms shall take effect upon being posted on the Site.
Continued use of the Service after such changes shall constitute acceptance of the revised Terms.
本規約は、Mixed Jiu Jitsu（以下「当サイト」といいます。）が提供する月額制動画配信サービス（以下「本サービス」といいます。）の利用条件を定めるものです。
第1条（適用）
本規約は、本サービスのすべての利用者に適用されます。
第2条（利用資格）
- 本サービスは18歳以上の方のみ利用可能です。
- 未成年者の利用は禁止します。
第3条（サービス内容）
本サービスは、動画を月額制で配信するものです。
第4条（決済）
- 決済は Memberpress及びStripeを通じて行われます。
- 月額料金は自動更新とします。お客様がキャンセルされない限り、毎月自動的に課金されます。
第5条（返金）
原則として返金は行いません。
ただし、技術的障害等当サイトが妥当と判断した場合に限り、個別に返金を検討します。
第6条（禁止事項）
利用者は以下の行為をしてはなりません。
- 動画のダウンロード
- スクリーンショット取得
- 録画
- 無断転載
- SNS・動画サイトへのアップロード
- 会員情報の第三者共有
- サーバーへの不正アクセス
- その他当サイトが不適切と判断する行為
第7条（強制退会）
利用者が本規約に違反した場合、当サイトは事前通知なくアカウントを停止または強制退会させることができます。
その場合、支払済み料金の返金は行いません。
第8条（知的財産権）
本サービス内のすべてのコンテンツの著作権および関連権利は当サイトまたは正当な権利者に帰属します。
第9条（損害賠償・違約金）
- 利用者が無断転載その他本規約違反を行った場合、当サイトは以下を請求できます。
(1) 実損害額
(2) 弁護士費用
(3) 1件あたり金100万円の違約金 - 前項の違約金は、損害賠償請求を妨げるものではありません。
第10条（免責）
- 通信障害・システム障害等によるサービス停止について、当サイトは重大な過失がない限り責任を負いません。
- 利用者間トラブルについて当サイトは関与しません。
第11条（データ保持）
退会後のデータ保持期間は、利用しているシステムの仕様に基づき合理的な期間保存されます。
第12条（準拠法・管轄）
- 本規約は日本法に準拠します。
- 本サービスに関する紛争については、福井地方裁判所を第一審の専属的合意管轄裁判所とします。
第13条（料金改定条項）
当サービスは、為替変動、物価変動、その他経済情勢の変化、またはサービス運営に必要と判断される事情が生じた場合、会員への事前通知を行った上で、月額料金を変更することがあります。料金改定後もサービスを継続利用された場合、利用者は改定後の料金に同意したものとみなします。
第14条（規約の変更）
- 当サイトは、必要と判断した場合には、本規約を予告なく変更できるものとします。
- 変更後の規約は、当サイト上に掲載した時点で効力を生じます。
- 利用者が変更後も本サービスを継続利用した場合、変更後の規約に同意したものとみなします。
